Brian W. Fitzgerald

Brian W. Fitzgerald has been practicing law and lobbying in Washington, D.C., for nearly 30 years. His public policy practice is bipartisan, having represented over the years a large number of companies and industries in a diverse range of public policy issues, including antitrust, banking, civil and criminal law reform, energy, environment, intellectual property, natural resources, real estate, securities, tax, telecommunications and trade. His public policy practice combines substantive expertise with public policy and political expertise.

Mr. Fitzgerald has represented numerous Fortune 500 companies and trade organizations on various energy and environmental matters, including Superfund, RCRA, clean energy initiatives, climate change, international and interstate waste transportation and disposal issues and numerous other energy and environment related matters. He served as outside policy counsel for many years for one of the primary trade organizations for the U.S. software industry, focusing primarily on copyright and patent issues, including the WIPO Copyright Treaty, the Digital Millennium Copyright Act, the No Electronic Theft Act, other amendments to the Copyright Act, patent reform and a number of domestic and international anti-piracy related issues. Mr. Fitzgerald has also served as outside tax policy counsel for a U.S. software company for over a decade.

Mr. Fitzgerald also has extensive experience in managing and working with public policy based coalitions. For example, he represented a coalition of Fortune 100 companies in a multi-year effort to enact comprehensive asbestos litigation reform, one of the largest and most complex public policy matters in history.
In addition to his public policy practice, Mr. Fitzgerald has expertise in federal election law, government ethics rules, and lobbying and foreign agent registration and reporting matters. He also has extensive experience in representing targets of congressional oversight and investigations matters.

Prior to entering private practice, Mr. Fitzgerald worked on the Majority Staff of the U.S. Senate Committee on the Judiciary, Subcommittee on the Constitution, under Subcommittee Chairman Birch Bayh (D-IN).

Mr. Fitzgerald received his J.D. from the Antioch School of Law, where he was a member of the Antioch Law Journal, and a B.S. in Business Management and Administration from Indiana University. He is admitted to the D.C. and Maryland bars.
